Aikimike, don't get me wrong. If you have a severe disability as spinal injury, cancer, or heart condition, then by all means get the future meds. However, if you had a torn ACL with all the surgery and rehab, then take out the future meds and get a higher settlement. Tax-free.
What's important is that there are two sides and the only who gets to decide is Czar. |

i just want to get better, i have to be well enough to shift gears in my new aston martin. lol
these are all excellent points and great advice, there is alot to do, and its all a big hassel because everything that you want done they deny, i got apporved for PT and then after the 1st visit it was pulled because of inssuficiant information on a doctros report. wierd.
im looking into what i can do. |

Czar,
You are certainly on a frustrating path and there are times when the W/C agents are hoping that you will get so frustrated that you will just give up and go away. That may be true in your case and I have nothing to judge that with. In any event, stick it out and it will eventually be worked out, hopefully in a way you can get on with your life. Best of luck. |

Aikimike has posted some great advice, I recommend that you use it.
One last thing, call your attorney and tell him that a local attorney told you X. It really doesn't matter what you tell him, the point is to make you a priority again. |

UPDATE:
so on tuesday i called my my employer and i asked to speak with the office manager/HR person. i asked if there was any work for me, without thinking she said NO!, that there wasnt any work available at all.
i let her finish and then i brought to her attention that there is an AD in the paper that they placed for an opening. now, wouldnt that be descrimination if they dont give me that position?? can they just say..NO WORK FOR YOU! ??? |

Nice. The best answer is depends.
Have you exhausted your TTD? Can or will your doc state certified yoru disability? Can you find another job?
If all else fails, take a read at Labor Code 132 (a); cited in pertinent part:
"It is the declared policy of this state that there should not
be discrimination against workers who are injured in the course and
scope of their employment." |

UPDATE:
so for a while as you all know ive been calling My former Employer to find out if there was work available..
so i called and i got the yosemite 2Step...back and fourth we went and then i get a call...
Hey! how are you...we need you to come in so we can discuss whats going to happen so you can come back to work..
i show up..and i'm greeted by this big bird looking prick known as Michael Dunn. hes the CFO for Yosemite waters..
and then lead into the conference room where i find the rest of the clan...
so we all sit down and im asked how im feeling and what not...small meaningless chatter...
then BOOM! i get hit with the wonderful news that I wont be able to come back to work for Yosemite Waters.
The reason Being that My once So called Friend that I referred to Yosemite for employment signed a so called affidavit stating that i had set him up as a new customer and that he never lived at this address.
Yosemite conducted an " investigation " into the matter and they based my discharge on this..
the date on the affidavit is November of 2008. they waited until they recieved my PNS report before they fired me..
sounds a little shady to me. if they conducted a full investigation into the matter, why would they wait until after i was cleared? or why not the day it was concluded that it was " false information "
